Terms of Service
These Terms of Service apply to all photography, videography, aerial, 3D tour, floor plan, virtual staging, and other media services provided by Desert Real Estate Media ("Desert Real Estate Media," "we," "us," or "our") to the client ("Client," "you," or "your").
1. Property Readiness & Access
The Client is responsible for having the property "camera ready" before the scheduled arrival window, including cleaning, decluttering, landscaping, and furniture staging.
Clients are encouraged to provide their clients with our Getting Ready Checklist prior to the appointment.
If the property is not ready when the Photographer arrives, Desert Real Estate Media may photograph or film the property in its existing condition ("As Is").
The Client is responsible for providing timely and unobstructed access to the property at the scheduled appointment time, including access to gated communities, buildings, rooms, garages, and other areas included in the order.
If the Photographer is unable to access the property due to the property being locked, unavailable, occupied, or otherwise inaccessible, the appointment may be treated as a cancellation and subject to the applicable cancellation fee. Additional waiting time or return-trip fees may apply.
The Client may provide preferences for specific angles or features by adding notes to the order or meeting the Photographer at the beginning of the appointment. Otherwise, the Photographer will use their professional judgment to determine the most effective composition and coverage.
2. Order Details & Pricing
The Client is responsible for providing accurate and complete information when placing an order, including property address, square footage, property type, requested services, and other relevant details.
Desert Real Estate Media reserves the right to correct inaccurate order information and adjust pricing accordingly.
Standard residential pricing applies to a single-family dwelling. Commercial, multi-unit, large-scale, or otherwise atypical properties may require a custom quote.
Additional services requested after the appointment has been scheduled or completed may be subject to additional charges.
3. Cancellations & Rescheduling
Confirmed appointments canceled or rescheduled within 24 hours of the scheduled start time are subject to a $50 cancellation/rescheduling fee.
Appointments that cannot be completed due to severe weather or unsafe conditions may be rescheduled without the cancellation fee.
Weather-related decisions, including whether aerial services can be safely performed, are at the discretion of the Photographer.
If only certain services are affected by weather—for example, aerial photography or exterior photography—Desert Real Estate Media may complete the unaffected services and reschedule the remaining services as appropriate.
4. Aerial Services
Aerial photography and video are subject to weather conditions, FAA regulations, airspace restrictions, property access, safety considerations, and other factors outside the control of Desert Real Estate Media.
If aerial services cannot be safely or legally performed, Desert Real Estate Media may reschedule the aerial portion of the appointment or, when appropriate, substitute available ground-based media.
5. Payment & Media Access
Payment is due through the online client portal prior to downloading full-resolution media.
Low-resolution previews or watermarked media may be provided for review prior to payment.
Full-resolution media will be made available for download once payment has been received.
Desert Real Estate Media may suspend access to media and/or future services for accounts with outstanding balances.
Accounts with balances more than 15 days past due may be assessed a $25 monthly late fee. Accounts with balances more than 45 days past due may have all media access and new orders suspended until the balance is paid in full.
Accounts with balances more than 90 days past due may be referred to collections. The Client may be responsible for reasonable collection costs and fees to the extent permitted by law.
6. Delivery Times
Unless otherwise specified in the order:
Next Business Day by 5:00 p.m.: HDR Photography
Second Business Day by 5:00 p.m.: Property Videos Virtual Twilight Virtual Staging 3D Virtual Tours Floor Plans
Delivery times begin following the date of the appointment.
Requests received after media delivery, including selections for Virtual Twilight or Virtual Staging, may be subject to additional turnaround time.
Delivery times are estimates and may be extended due to circumstances outside the reasonable control of Desert Real Estate Media.
7. Client Review, Corrections & Reshoots
The Client is responsible for reviewing delivered media and notifying Desert Real Estate Media of any technical errors or omissions within a reasonable period following delivery.
If an error is the result of Desert Real Estate Media's work, we will make reasonable corrections or provide an appropriate replacement at no additional charge.
Requests resulting from changes to the property, staging, furniture, decor, lighting, weather, client preference, or other circumstances outside the control of Desert Real Estate Media may require a reshoot and may be subject to additional charges.
Reshoots requested solely because of a change in Client preference are not considered corrections and may be billed at the applicable service rate.
8. Service Area & Travel
Standard pricing includes travel within the Greater Palm Springs area, including: Palm Springs, Desert Hot Springs, Cathedral City, Thousand Palms, Palm Desert, Rancho Mirage, Indian Wells, La Quinta, Indio, Coachella, Thermal, Mecca, and Morongo Valley.
Properties outside the standard service area but within our extended service area are subject to a $125 travel fee. This includes: Yucca Valley, Joshua Tree, Mountain Center, Idyllwild, Banning, Beaumont, San Jacinto, Hemet, Moreno Valley, Calimesa, Yucaipa, and Redlands.
Locations beyond these areas may be subject to additional travel charges and will be quoted individually.
9. Hosting & Media Storage
Desert Real Estate Media provides media hosting for up to one year from the appointment date, unless otherwise specified.
Matterport 3D Tours and associated floor plans may be hosted for up to six months or until the property is sold, whichever occurs first.
After the applicable hosting period expires, media may be removed from our hosting platforms. The Client is responsible for downloading and permanently storing any media they wish to retain.
Desert Real Estate Media is not responsible for maintaining permanent archives of Client media after the applicable hosting period.
10. Copyright & Ownership
Unless otherwise agreed in writing, Desert Real Estate Media retains all copyrights and ownership rights to photographs, videos, aerial media, 3D content, floor plans, graphics, and other original media created as part of the services ("Work").
Payment for services does not constitute a transfer of copyright or ownership.
11. Client Usage Rights
Upon payment in full, Desert Real Estate Media grants the Client a non-exclusive, non-transferable license to use the delivered Work for the marketing and promotion of the property and the Client's real estate business.
Permitted uses include, but are not limited to: MLS and real estate listing platforms Property websites Social media Brokerage websites Digital and print advertising Brochures and promotional materials Email marketing Marketing the Client's real estate services
The Client may authorize real estate platforms and other marketing services to display the Work for these purposes.
The Client may not sell, sublicense, transfer, or otherwise distribute the Work as a standalone product or for purposes unrelated to the marketing of the property or the Client's real estate business without prior written permission from Desert Real Estate Media.
12. Portfolio & Promotional Use
The Client grants Desert Real Estate Media permission to use completed Work for its portfolio, website, social media, advertising, promotional materials, competitions, publications, and other self-promotional purposes.
If the Client has a specific concern regarding promotional use of a property, they should notify Desert Real Estate Media in writing before the appointment.
13. Client Authorization & Property Rights
The Client represents that they are authorized to order media services for the property and have obtained any necessary permissions from the property owner, occupants, property manager, HOA, or other parties with authority over the property.
The Client is responsible for obtaining any necessary permissions or releases relating to people, artwork, trademarks, architectural works, personal property, or other intellectual property captured in the Work.
The Client agrees to indemnify and hold harmless Desert Real Estate Media from claims arising from the Client's failure to obtain required permissions or from the Client's unauthorized use of the Work.
14. Indemnification
The Client agrees to indemnify and hold harmless Desert Real Estate Media, its owners, employees, contractors, agents, licensees, and affiliates from claims, damages, losses, expenses, and reasonable attorneys' fees arising from: The Client's breach of these Terms of Service; The Client's negligent or intentional acts or omissions; The Client's unauthorized use or distribution of the Work; The Client's failure to obtain required permissions or releases; or Claims arising from the property, its occupants, guests, or other persons present at the property, except to the extent caused by the negligence or willful misconduct of Desert Real Estate Media.
15. Limitation of Liability
To the maximum extent permitted by law, Desert Real Estate Media's liability arising from or related to the services provided shall be limited to the amount actually paid by the Client for the specific services giving rise to the claim.
Desert Real Estate Media shall not be liable for indirect, incidental, consequential, or special damages, including lost profits, lost sales, missed opportunities, or other business losses.
Desert Real Estate Media will make reasonable efforts to protect and preserve Client media but cannot guarantee against equipment failure, data loss, platform outages, or other circumstances beyond our reasonable control.
16. Circumstances Beyond Our Control
Desert Real Estate Media will not be responsible for delays, cancellations, or inability to perform services caused by circumstances beyond our reasonable control, including severe weather, natural disasters, illness, accidents, equipment failure, power outages, government restrictions, FAA or airspace restrictions, property access issues, platform outages, or other unforeseen circumstances.
In such cases, Desert Real Estate Media will make reasonable efforts to reschedule or otherwise complete the affected services.
17. Acceptance of Terms
By placing an order with Desert Real Estate Media, the Client acknowledges that they have read, understood, and agreed to these Terms of Service.
These Terms of Service may be updated periodically. The version in effect at the time an order is placed will govern that order unless otherwise agreed to in writing.
